Motivações da decisão: como o juiz credibiliza as testemunhas

A presente investigação procura averiguar a existência de factores que influenciam a tomada de decisão judicial, do ponto de vista das motivações ajurídicas dos juízes. Assim, a motivação expressa pelo juiz perante cada depoimento foi tida em conta, de modo a perceber qual o grau de envolvimento despendido nos diferentes depoimentos, percebendo de que modo a Comunicação Não Verbal (CNV) dos atores judiciários, influencia o juiz na tomada de decisão.
Realizou-se um trabalho de observação, no 1º e 8º Juízo do Tribunal Criminal de Lisboa, tendo sido aplicada a Grelha de Observação das Motivações Ajurídicas do Sentenciar (Louro, 2005). Foram observados 46 julgamentos com um total de 147 personagens judiciais, nomeadamente 35 arguidos, 15 vítimas, 22 testemunhas arroladas pelo arguido e 75 testemunhas arroladas pela vítima, dos quais 47 eram do sexo feminino e 100 do sexo masculino. Houve diferenças significativas entre os atores judiciais, no que concerne à Comunicação Não-verbal. Os resultados foram analisados e fundamentados com base na literatura revista.
The present research seeks to determine the factors that take part on the judicial decision making from the point of view of judges motivations. Therefore the motivation expressed by the judge before each testimony was counted for in order to understand the degree of involvement spent on the different testimonies realizing how nonverbal communication of judicial actors do influence the judge when it comes to decision making. We conducted an observational work on the 1st and 8th Criminal Court's Judgment of Lisbon on which the Grid Observation of Non Judicial Motivations Sentencing (Louro, 2005) has been applied. We observed 46 trials with a total of 147 legal characters, those included 35 defendants, 15 victims, 22 witnesses presented by the accused and 75 witnesses presented by the victim, of which 47 were female and 100 male. There were significant differences between the judicial actors, regarding the Nonverbal Communication. The results were analysed and based based on the revised literature.
