Poiares, Carlos Alberto, orient.Ferreira, Beatriz Gonçalves2017-01-092017-01-092016http://hdl.handle.net/10437/7577Orientação: Carlos Alberto PoiaresA presente dissertação tem como principal objetivo aliar a técnica do desenho infantil ao Criteria-based Content Analysis (CBCA), um dos instrumentos mais usados em todo o mundo para avaliação dos testemunhos, inicialmente criado para aplicação isolada a uma população de crianças vítimas de abuso sexual. Deste modo, pretende-se integrar uma componente verbal (análise das declarações através do CBCA) e uma componente não verbal (análise do desenho) na avaliação do testemunho. É ainda descrita a entrevista cognitiva, de aplicação prévia ao CBCA, bem como uma possível adaptação dos critérios básicos do referido instrumento a problemáticas distintas e diferentes populações. São igualmente objeto de análise questões respeitantes à temática da mentira, sobretudo em contexto testemunhal, visando a sua clarificação, por meio da comparação das principais técnicas utilizadas para a sua deteção. Após identificados os erros mais expressivos neste contexto, apresentam-se estratégias e instrumentos para os superar, e alcançar a verdade. O estudo inclui também uma abordagem às características fundamentais da Psicologia do Testemunho, a qual patenteia a verdade e a mentira como alicerces, a intervenção juspsicológica e sua relação com o Direito, abrangendo ainda o estudo dos principais processos psicológicos, os quais se encontram na base de tudo o que se vê, ouve e sente, exercendo uma forte influência na veracidade dos testemunhos, em âmbito judicial. Com o intuito de enfatizar o papel do psicólogo forense no referido âmbito, foi elaborada uma proposta de intervenção.This dissertation has for main purpose combining the children’s drawing technique to the Criteria-based Content Analysis (CBCA) a well-known instrument for testimony evaluation, initially used as a solo method of analysis in the interviews of sexually abused children. Thus integrating both a verbal (analysis of statements through CBCA) and a nonverbal component (drawing analysis) in the testimony’s evaluation. It also describes the cognitive interview for previous application of the CBCA, and a possible adaptation of its basic criteria for distinct issues and populations. Some topics of the theme of lie in the field of testimony are analyzed, in the attempt to clarify them, through the comparison of its major detection techniques. For the main errors identified, possible strategies and tools are proposed to overcome them, in order to reach the truth. The study also includes an approach to fundamental characteristics of testimony psychology - which exhibits truth and lie as its foundations – then exploring juspsicológica intervention and its close relation with the law, and finally lead to main psychological processes - which form the basis of everything we see, hear and feel – exerting a strong influence on the truthfulness of a testimony in judicial context.
