É feita a crítica da primeira concepção e do Tratado Constitucional que, segundo o Autor, se revelará altamente instável. Com base na distinção entre interesses comuns colectivos e interesses comuns individuais dos estados membros, o Autor considera desejável que a Europa avance para um caso especial de confederação, ou seja para a solidificação de uma rede não exclusiva de Estados.This paper confronts two different conceptions about the future of the European Union: the European Super-state, which assumes itself as the equivalent to the concept of a “Citizen's Europe”, and the concept of a Europe as a confederation of states, i.e., the “Europe of States”. The first conception and the constitutional treaty are strongly criticized, since they would reveal themselves highly unstable, according to the author.
