Atualmente, o cenário da população mundial encontra-se em constante mutação, estando em crescente fase de envelhecimento, o que fomenta a probabilidade de, cada vez mais, aparecerem testemunhas idosas para prestar depoimentos na justiça. Como tal, são necessárias investigações que apurem a credibilidade dos mesmos, visto que o envelhecimento é uma fase em que ocorre uma panóplia de declínios a todos os níveis, especialmente, ao nível psicológico e cognitivo, onde se inserem os principais processos que atuam quando presenciamos um cenário de crime. Após a revisão da literatura, propomo-nos a analisar se o testemunho dos idosos em tribunal pode ser considerado credível, devido ao decréscimo no seu desempenho inerente à idade, bem como em razão de todas as fragilidades que a mesma acarreta.This theoretical-epistemological thesis elaborated by analyzing the literature on the problem, aims to analyze the credibility of the elderly witness in court. Currently, the scenario of the world population is constantly changing and being in ascending aging stage, which fosters the likelihood of increasingly appearing elderly witnesses to testify in court. As such, investigations are needed to find out the credibility of the same, since aging is a stage where a panoply of declines occur at all levels, especially the psychological and cognitive level, where are located the main processes when we witness a scene of crime.
