Resumo
A dissertação de mestrado que se segue realizada na área de direito processual
do trabalho, consiste na apresentação de um estudo sobre o acidente de trabalho e o seu
processo especial de cariz teórico e prático que se debruçará sobre o conceito de
acidente de trabalho analisando para o efeito os seus pressupostos.
Nesse sentido, passei a analisar os diplomas que o regularam e os que
presentemente regulam a matéria dos acidentes de trabalho.
Entre eles foi feita uma análise comparativa, de forma a obter um balanço
conclusivo acerca da evolução legislativa infortunística deste tema em Portugal.
Fá-lo-ei também com referência a algumas decisões jurisprudenciais.
Este estudo não pretende ser exaustivo na análise de todo o regime dos
acidentes de trabalho, nem do acervo dos temas abrangidos, procurando antes identificar
as questões tidas como principais.
The following master’s essay, developed in the area of procedural labour law, consists of the presentation of a study about work accident and its special process of theoretical and practical nature, which will focus on the concept of accident at work and will analyze, for this purpose, its assumptions. So I´m going to review the law diplomas which regulated work accidents in the past and the ones that regulate them nowadays. Among other things, a comparative analysis was made in order to achieve a final report about the legislative developments of this topic in Portugal. I will also accomplish our study based in some court decisions. This study is neither intended to be an exhaustive analysis of the complete Labour Code, nor an entire holding of the covered issues. Its purpose is rather to identify the key issues.
