A presente investigação tem como finalidade inicial efectuar uma análise prévia das potencialidades avaliativas da Grelha para Análise das Motivações Ajurídicas do Sentenciar (GAMAS) (Poiares, 2005). Procura averiguar a existência de factores que influenciam a tomada de decisão judicial, do ponto de vista das motivações dos juízes, de onde provêm e qual o grau de importância que esses factores assumem no sentenciar, tendo em conta um aspecto fundamental, a comunicação não verbal.
Para a realização desta investigação realizou-se um trabalho de observação nas Varas Criminais e no 1º Juízo Criminal de Lisboa. Foram observados 20 julgamentos, com o total de 116 sujeitos (arguidos, vítimas e testemunhas) 38 do sexo feminino e 78 do sexo masculino, dos quais 27 eram arguidos, 17 vítimas e 72 testemunhas. Foi possível verificar diferenças significativas no que concerne ao comportamento não verbal apresentado por arguidos, vítimas e testemunhas. Os resultados foram analisados e fundamentados com base na literatura consultada.
This research aims to make an initial preliminary analysis of the evaluative capabilities of the Grid for the Analysis of non judicial Motivations Sentencing (GAMAS) (Poiares, 2005). It seeks to investigate the existence of factors that influence judicial decision making, from the standpoint of the motivations of the judges, from where and to what degree of importance these factors assume in the sentencing, taking into account one fundamental aspect such a nonverbal communication. To carry out this investigation we carried out observation work in the Criminal Court and the 1st Criminal Court of Lisbon. We observed 20 trials with a total of 116 subjects (defendants, victims and witnesses) 38 females and 78 males, 27 of whom were defendants, 17 victims and 72 witnesses. It was possible to identify significant differences with regard to nonverbal behavior presented by defendants, victims and witnesses. The results were analyzed and justified based on published data.
