LBSE : a resiliência democrática de um consenso conjuntural

dc.description.abstractComo prerrogativa da Assembleia da República, a Lei de Bases do Sistema Educativo (LBSE) foi (e permanece como) uma construção legislativa exem plar, a vários títulos, resultado do trabalho dos diferentes partidos represen tados na AR. Mas vale a pena salientar, de modo particular, a dedicação, a capacidade de diálogo e o labor metódico, individual e coletivo, dos deputados da subcomissão de educação, ciência e cultura, com a coordenação carismá tica de Bártolo Paiva Campos e a sensibilidade interpretativa de Eurico Le mos Pires, que soube traduzir, em textos prévios, para discussão e aprovação posterior alargada, os mais diversos contributos. Este artigo elege algumas questões a propósito da LBSE ou dela decorrentes, pretendendo ao mesmo tempo ser um reconhecimento ao trabalho destes dois deputados e académi cos e, de modo mais pessoal, um singelo tributo à memória de Lemos Pires. A LBSE foi elaborada sem interferência do Governo de então, e até com algum estranho distanciamento, dado o facto de a Comissão de Reforma do Sis tema Educativo (CRSE) ter iniciado os trabalhos antes da aprovação desde importantíssimo normativo. Mas depois de aprovada, a LBSE passou a ser a referência fundamental para a reorganização do sistema educativo, a come çar pela influência marcante nos estudos e propostas daquela que viria a ser a última reforma global da educação em Portugal. A LBSE induziu e legitimou algumas políticas e decisões governativas referenciáveis aos direitos do Es tado-providência na educação, num contexto de modernização e de tensões contraditórias em grande parte resultantes da agenda neoliberal emergen te. Passadas quatro décadas, o futuro da LBSE está agora profundamente dependente dos futuros possíveis para a educação, nomeadamente da for ma como se equacionarem e resolverem muito dos problemas até há pouco desconhecidos e doravante com crescente centralidade – o que nos obriga a repensar as certezas que tínhamos e as utopias emancipatórias que imaginá vamos poder concretizar.pt
dc.description.abstractAs a prerogative of the Assembly of the Republic (AR), the Education Act (LBSE) was (and remains) an exemplary legislative construction in several respects, resulting from the work of the different parties represented in the AR. But it is worth highlighting, in particular, the dedication, the capacity for dialogue, and the methodical work, both individually and collectively, of the members of the Portuguese Parliament on the subcommittee on education, science, and culture, with the charismatic coordination of Bártolo Paiva Campos and the interpretative sensitivity of Eurico Lemos Pires, who knew how to translate, in preliminary texts, for discussion and subsequent expanded approval, the most diverse contributions. This essay selects some issues concerning the LBSE or arising from it, intending at the same time to be a recognition of the work of these two members of the Portuguese Parliament and academics and, in a more personal way, a simple tribute to the memory of Lemos Pires. The LBSE was drafted without interference from the then-Government, and even with some strange detachment, given the fact that the Commission for the Reform of the Education System (CRSE) began its work before the approval of this very important regulation law. But after its approval, the LBSE be came the fundamental reference for the reorganization of the educational system, beginning with its significant influence on the studies and proposals of what would become the last important global education reform in Portugal. The LBSE induced and legitimized some government policies and decisions referring to the rights of the welfare state in education, in a context of modernization and contradictory tensions largely resulting from the emerging neoliberal agenda. Four decades later, the future of the LBSE is now deeply dependent on the possible futures for education, namely on how many of the problems that were previously unknown and are now increasingly central are addressed and resolved – which forces us to rethink the certainties we had and the emancipatory utopias we imagined we could realize.
