dc.description.abstractCada vez mais nos dias que correm, sente-se a necessidade da interligação da Psicologia e do Direito em diversas esferas do mundo judicial, na medida em que se complementam. Uma das áreas em que é notório o contributo da Psicologia reside na formação da vontade (= opção) decisória e no âmbito das motivações ajurídicas do sentenciar. Deste modo, o presente estudo tem como principal objetivo a análise dos fatores que influenciam a decisão do juiz e as suas motivações para valorizar mais o discurso de um sujeito em detrimento do outro, com base nos estímulos dados pelos mesmos e nas suas discursividades (comportamento verbal e não-verbal). A investigação foi elaborada com base na Grelha para Análise das Motivações Ajurídicas do Sentenciar (GAMAS), realizando-se um trabalho de observação no Tribunal Judicial da Comarca de Lisboa - Juízo Central Criminal de Lisboa, com a aplicação da grelha. A amostra é constituída por 10 julgamentos, com o total de 35 personagens judiciais (arguidos, vítimas e testemunhas). Os resultados obtidos conferem a validade e a consistência interna da grelha e confirmam a existência de motivações ajurídicas nas decisões judiciais.pt
dc.description.abstractCurrently, there is a need for the interconnection of Psychology and Law in various areas of the judicial world as they complement each other. One of the areas in which the contribution of Psychology is notorious is based on the formation of the will (=option) and the non-legal motivations of sentencing. Thus, the present study has as its main objective the analysis of the factors that influence the judge's decision and his motivations to value more the testimony of one subject over the other, based on the stimuli given by them and their discursivities (verbal and nonverbal behavior). The investigation was based on the Grid for Analysis of Motivations in Sentencing of Non-judicial Sentencing (GAMAS). The observational job was carried out at the Judicial Court of the District of Lisbon – Central Criminal Court of Lisbon with the application of the grid. The sample consists of 10 trials, with a total of 35 court characters (defendants, victims and witnesses). The results confer the validity and internal consistency of the grid and confirm the existence of non-legal motivations in court decisions.en
