A presente dissertação encontra-se inserida no âmbito do mestrado em Psicologia Forense.
Pretendeu apurar o índice de severidade na atribuição das penas no julgamento de crimes contra
a pessoa e contra o património, no Sistema Judicial Português. O objeto de pesquisa empírica
é a severidade punitiva e a psicologização, particularmente presentes nos crimes de furto
qualificado, violência doméstica, burla informática e ofensa à integridade física simples.
Procurou-se compreender o peso da psicologização, ou seja, o papel de todas as atividades
psicológicas no processo de tomada de decisão, sempre que solicitada uma intervenção neste
domínio, com o intuito de compreender se uma maior psicologização influenciava a severidade
das penas. Para a realização do estudo procedeu-se à análise documental de 43 processos
judiciais transitados em julgado. Os dados foram recolhidos no Estabelecimento Prisional de
Linhó, com recurso ao Índice de Severidade Penalizadora e Psicologização-Criminalização
Secundária (ISPP-CS). A comunidade teórica encontra-se dividida acerca da eficácia da
severidade da pena no combate à criminalidade, mas mostra-se consensual que os serviços de
Psicologia Forense podem melhorar a realização da justiça. Contudo, os resultados da presente
investigação revelaram uma procura nula dos serviços de psicologia, e um grau mínimo de
severidade penal na aplicação da pena. Estes resultados, apesar de não serem representativos
da população, permitem questões importantes sobre a criminalização e o processo de prevenção
especial no sentido de promover um sistema mais consciente e políticas mais coerentes.
The present dissertation, inserted in the scope of master's degree in Forensic Psychology, was guided by a mixed approach and the intended goal was to ascertain the severity index in the attribution of sentences in trial of crimes against person and property, in Portuguese Judicial System. The object of empirical research is the punitive severity and psychologization, present, particularly in crimes of theft, domestic violence, computer fraud and simple offense to physical integrity. We sought to understand the weight of psychologization, that is, the role of all psychological activities in decision-making processes, whenever an intervention in this domain is requested, with the goal of understanding whether greater psychologization influenced the severity of the sentences. In order to carry out the study, a documentary analysis was carried out of 43 legal proceedings. Data were collected at the Linhó Prison, using the Penalty Severity Index and Psychologization-Secondary Criminalization (PSIP-SC). The theoretical community is divided on the effectiveness of the severity of the sentence in combating crime, but it is widely agreed that the services of Forensic Psychology can improve the realization of justice. However, the results of the present study revealed a zero demand for psychology services, and a minimum degree of penal severity in the application of penalty. These results, despite not being representative of the population, allow important questions about criminalization and the special prevention process in order to promote a more conscious system and more coherent policies.
