Postulada a existência de fatores extralegais que condicionam o exercício equitativo da justiça
é pertinente estudar a interação entre determinados atores judiciais e a decisão final do juiz.
O objetivo da presente investigação é averiguar se o depoimento policial é credibilizado com
frequência na formação da convicção do julgador e, simultaneamente, pretende-se captar, em
cenário real, as relações comunicacionais que ocorrem entre o juiz e a testemunha policial
durante a audiência, para que sejam catalogados os elementos da discursividade que mais
interferem na decisão final do juiz. Na impossibilidade de realizar a presente investigação em
cenário real, delineou-se uma nova metodologia mantendo como objetivo averiguar uma
possível credibilização do testemunho policial e elencar, com base na motivação de facto, o
que esteve na origem desta credibilização. Através da análise de conteúdo de 37 acórdãos dos
Tribunais da Relação, os resultados apontam para uma credibilização das testemunhas
policiais.
Postulated the existence of extra-legal factors that affect the fair administration of justice, is relevant to study the interaction between certain judicial actors and the final decision of the judge. The purpose of this research is to ascertain if the police testimony is credible, often in the formation of the judge's conviction and, at the same time with the intention of capturing in real scenario the communication relationships that occur between the judge and police witnesses during the hearing, in order to catalog the discourse elements which have more influence in the final decision of the judge. Unable to carry out this research in real scenario, a new methodology was outlined, keeping the main objective of investigating a possible credibility of police testimony and to rank it, based on the fact's motivation, which led to this credibility. Through content analysis of 37 judgments of the Tribunal da Relação, the results point to a credibility of police witnesses.
