Resumo
Neste artigo são postas em confronto duas concepções sobre o futuro da União Europeia: o Superestado Europeu, que se considera equivalente ao conceito de “Europa dos Cidadãos” e a Europa como confederação de Estados, que se considera equivalente ao conceito de “Europa dos Estados”. É feita
a crítica da primeira concepção e do Tratado Constitucional que, segundo o Autor, se revelará altamente instável. Com base na distinção entre interesses comuns colectivos e interesses comuns individuais dos estados membros, o Autor considera desejável que a Europa avance para um caso especial
de confederação, ou seja para a solidificação de uma rede não exclusiva de Estados.
This paper confronts two different conceptions about the future of the European Union: the European Super-state, which assumes itself as the equivalent to the concept of a “Citizen's Europe”, and the concept of a Europe as a confederation of states, i.e., the “Europe of States”. The first conception and the constitutional treaty are strongly criticized, since they would reveal themselves highly unstable, according to the author. Based on the distinctions between the collective and the individual common interests of the member states, the author recommends that Europe should advance to reach a special type of confederation, i.e., to consolidate of a network non-exclusive of states.
