The Administrative Offenses Legal Framework (Regime Geral das Contraordenações) was established by Decree-Law No. 433/82 of 27 October with a clear objective: to combat the over-criminalisation that had become increasingly apparent. Conduct that did not warrant the imposition of a criminal penalty, but nevertheless required a sanction (an administrative offence sanction), would therefore be removed from the scope of criminal law and placed within this branch of sanctioning law. From this perspective, the legislative initiative was undoubtedly commendable. However, when examining the path that the administrative offences system (ilícito de mera ordenação social – IMOS) has taken—without making any value judgment at this stage—it becomes clear that its development has been marked by constant and complex advances and setbacks. It is therefore necessary to assess whether the General Regime of Administrative Offences (RGCO), introduced by Decree-Law No. 433/82, is capable of governing the IMOS as a whole within the broader framework of sanctioning law, or whether the proliferation of sectorspecific regimes undermines its coherence and even its very existence. To address this question, we examine a number of concrete examples.
