Resumo
Governo de três níveis, governo federal, estadual / provincial e local é comum a
todos os sistemas constitucionais; no entanto, o lugar e o papel do governo local nestes
sistemas variam acentuadamente. Em alguns, o governo local é constitucionalmente
reconhecido na esfera de governo, enquanto noutros é apenas uma competência do
governo estadual / provincial. No entanto, o governo local tem um papel crescente na
governança dos países, colocando novas necessidades à teoria e à prática do
constitucionalismo. Além disso, o seu status está a mudar ao longo dos últimos anos,
com o seu novo papel.
Neste sentido, a organização interna, composição e constituição dos órgãos
locais consubstanciam um sistema de governo autárquico cuja classificação não reúne,
também aqui, consenso, e cuja adjetivação vai desde sui generis, estranho a insólito.
Embora se fale numa reforma do sistema de governo local há vários anos, as alterações
ao mesmo apontadas como necessárias para torná-lo eficaz e, acima de tudo, lógico,
tardam em chegar, visto que a introdução de uma nova lei autárquica assume-se como
algo muito difícil de concretizar dado as diametralmente opostas sugestões apresentadas
e as diferentes ideologias políticas subjacentes às mesmas.
As mudanças rápidas que foram sendo alimentadas pela economia mundial e
tecnologias forçaram as organizações a transformar-se de forma mais ágil e competitiva.
O sistema de Governo Autárquico Territorial, assenta numa base de sistema misto ou
dualista. Porém esta nomenclatura é meramente académica e não uma designação
corrente entre os autores clássicos ou na classe política.
O objetivo do presente trabalho é a análise e interpretação do Sistema de
Governo Autárquico Territorial, em Portugal e outros países como Angola, França,
EUA, Alemanha.
O sistema de Governo Autárquico Territorial, assenta numa base de sistema
misto ou dualista. Porém esta nomenclatura é meramente académica e não uma
designação corrente entre os autores clássicos ou na classe política. Ao longo do
trabalho iremos demostrar essa mesma realidade.

However, local government has a growing role in the governance of countries, placing new needs on the theory and practice of constitutionalism. Although there has been talk of a reform of the local government system for several years, the amendments thereto are seen as necessary to make it effective and, above all, logical, are slow to arrive, since the introduction of a new autarkic law is assumed as something very difficult to achieve given the diametrically opposed suggestions presented and the different political ideologies underlying them. The rapid changes that have been fueled by the global economy and technologies have forced organizations to transform in a more agile and competitive way. The system of Territorial Autarchic Government is based on a mixed or dual system. But this nomenclature is merely academic and not a common term among classical authors or in the political class. The objective of this work is the analysis and interpretation of the Territorial Autarchic Government System in Portugal and other countries such as Angola, France, USA, Germany.
