Crime de violência doméstica e a compatibilidade com a aplicação da justiça restaurativa

Resumo
Esta dissertação analisa o crime de violência doméstica a luz do artigo 152.º do Código Penal Português, com breve analise de sua evolução e as alterações legislativas em busca de uma melhor eficácia do sistema penal, explorando as possibilidades da aplicação da Justiça Restaurativa antes e durante o processo judicial, como abordagem complementar. Como angulo principal, tem o propósito de analisar e levantar questões em busca de melhores respostas para este que e um problema social complexo, com raízes culturais e históricas profundas, onde a sociedade frequentemente exige várias respostas. Nesse sentido, levanta-se questões importantes quanto as medidas atualmente aplicadas neste crime, bem como a possibilidade de utilização dos meios restaurativos na justiça, integrando a proteção das vítimas e a ressocialização dos agressores, em casos menos gravosos deste tipo penal. O presente estudo destaca os avanços legais na legislação atual, incluindo a ampliação dos sujeitos protegidos e a introdução de medidas como a Suspensão Provisoria do Processo e a Suspensão da Execução da Pena de Prisão, mas também questiona uma melhor utilização dos meios já disponíveis e que merecem atualização para uma aplicação mais efetiva, principalmente na Lei da Mediação Penal, que prevê em seu texto uma alteração que até o momento não ocorreu. Como resultado desta investigação, destaca-se a necessidade de superar as limitações da justiça punitiva tradicional, incorporando praticas restaurativas na fase de inquérito, priorizando o diálogo na busca pela reparação e a prevenção da reincidência, o que requer uma abordagem holística e multidisciplinar, combinando sanções penais rigorosas com políticas públicas que promovam a educação, o apoio às vítimas e a transformação social.
This dissertation analyzes the crime of domestic violence in the light of Article 152 of the Portuguese Penal Code, with a brief analysis of its legislative evolution and the legislative changes in search of a better effectiveness of the penal system, exploring the possibilities of applying Restorative Justice before and during the judicial process, as a complementary approach. As a main angle, it aims to analyze and raise questions in search of better answers to what is a complex social problem, with deep cultural and historical roots, where society often demands various responses. In this sense, it raises important questions about the punishable measures currently applied to this crime, as well as the possibility of using restorative means in justice, integrating the protection of victims and the resocialization of aggressors, in less serious cases of this type of crime. This study highlights the legal advances in current legislation, including the expansion of protected subjects and the introduction of measures such as the Provisional Suspension of Proceedings and the Suspension of Execution of the Prison Sentence, but also questions the better use of the means already available and which deserve updating for more effective application, especially in the Criminal Mediation Law, which provides for an amendment in its text that has not yet occurred. As a result of this research, the need to overcome the limitations of traditional punitive justice is highlighted, incorporating restorative practices in the investigation phase, prioritizing dialogue in the search for reparation and the search for the main objective, the prevention of recidivism, which requires a holistic and multidisciplinary approach, combining strict criminal sanctions with public policies that promote education, support for victims and social transformation.
