A ligação entre os direitos humanos e o processo penitenciário é inegável, não só pelos
direitos que se subtraem aquando de uma condenação, como pelas condições específicas
em que são cumpridas as medidas penais, desde logo, na supressão da liberdade. Deste
modo, este estudo empírico visa ser um contributo para a compreensão e aferição da
garantia dos direitos humanos no sistema penitenciário português. Para tanto, foi utilizado
um instrumento denominado Grelha de Avaliação de Situação Penitenciária, construído
ao longo da análise de 60 processos individuais únicos de reclusos dos estabelecimentos
prisionais de Sintra e do Linhó. Cogitou-se assim verificar se os direitos humanos são
assegurados durante o percurso penitenciário em Portugal, e em que medida a execução
da pena trabalha a reinserção social prevista no Código Penal Português, objetivo
primário de toda a pena. Os resultados não permitiram tirar conclusões definitivas sobre
o objetivo a que se propôs este estudo, na medida em que os dados se demonstraram
inconsistentes, ou porque existe ausência de informação. Contudo, do que foi possível
apurar, verificou-se a necessidade de cumprimento do Regime Geral dos
Estabelecimentos Prisionais no que à organização do processo individual único tange, o
que nem sempre acontece, bem como a valorização de todos os eixos da vida do sujeito,
para que a pena de prisão seja um processo de reprogramação do sujeito, endógeno,
sustentado e com repercussões positivas na reinserção social.
The link between human rights and the penitentiary process is undeniable, not only because of the rights that are subtracted at the time of a conviction, but also because of the specific conditions under which penal measures are served, in the first place, in the suppression of freedom. Thus, this empirical study aims to be a contribution to the understanding and assessment of the guarantee of human rights in the Portuguese penitentiary system. For this purpose, an instrument called the Prison Situation Assessment Grid was used, built through the analysis of 60 unique individual cases of inmates from the prisons of Sintra and Linhó. Therefore, it was considered to verify if human rights are guaranteed during the penitentiary path in Portugal, and to what extent the execution of the sentence works towards the social reintegration provided for in the Portuguese Penal Code, the primary objective of any sentence. The results did not allow definitive conclusions to be drawn about the purpose of this study, as the data proved to be inconsistent, or because there was a lack of information. However, from what was possible to ascertain, there was a need to comply with the General Regime of Prison Establishments regarding the organization of the unique individual case, which does not always happen, as well as the appreciation of all axes of the subject's life, for the prison sentence to be a process of reprogramming the subject, endogenous, sustained and with positive repercussions on social reintegration.
