dc.description.abstractOs princípios fundamentais são a base real que caracterizam o registo predial na sua estrutura, definição e informação. Esta base real, juridicamente relevante, tem por alicerce o princípio da especialidade. Tem este princípio a função de determinar a obrigatoriedade de atribuir ao prédio todos os elementos que o caracterizam e identificam. O nosso ordenamento jurídico atribui ao registo predial o dever de funcionar num sistema de base real compreendido, esta, pela Descrição Predial. É na Descrição predial que assenta todo o processo de registo. A Descrição predial é a única figura responsável pela informação fidedigna, da identificação do prédio constante nos serviços de registo. Os requisitos da identificação do prédio começam pela descrição da sua composição, área, confrontações, identificação fiscal, nome do seu possuidor (s) e menção do título (s) probatório. A Descrição é, portanto onde inicia e se centraliza tudo o que diz respeito ao prédio, o (prédio mãe) e onde são mencionadas todas as alterações, modificações, retificações ou anotações, através de averbamentos, desde que o seu possuidor, ou pessoa com legitimidade para pedir a atualização tenha nisso interesse e justifique o seu pedido de averbamento. O registo predial é obrigatório. Destina-se a dar publicidade à situação jurídica do prédio. Pode ser efetuado pessoalmente, por via eletrónica ou por correio e atualmente tem competência para o pedir em sede de Balcão Único de advogados, de câmara de comércio e indústria, de cartório notariais, de serviços de registo, conservatórias-casa pronta e de solicitadores. Com a desformalização territorial pode ser apresentado em qualquer conservatória. E é essa que formaliza todo o processo na conservatória correspondente à localização do imóvel. As entidades com competência para a feitura e apresentação do registo obedecem à tramitação do código do notariado.pt
dc.description.abstractThe fundamental principles of the land registers are the real base featuring in his own structure, definition and information.
