dc.description.abstractO presente estudo pretende analisar as motivações ajurídicas do sentenciar na justiça criminal portuguesa, tendo como objeto de estudo o papel das testemunhas em tribunal e como estas podem influenciar a tomada de decisão, erigindo como referente a ancoragem jus psicológica: a perspetiva da Psicologia quando penetra no espaço jurídico judicial, quer na investigação quer na intervenção. O principal objetivo da investigação é a análise de fatores que possam influenciar a tomada de decisão judicial e se estas motivações têm origem principal na comunicação verbal ou na comunicação não-verbal dos depoentes. Para esta investigação foi utilizada a Grelha de Análise das Motivações Ajurídicas do Sentenciar (GAMAS) (Poiares, 2005), aplicada no Tribunal Judicial da Comarca de Lisboa – Juízo Central Criminal de Lisboa. A amostra é constituída por 13 julgamentos, no qual se identificaram 92 atores judiciais, sendo que 56 eram testemunhas, 16 testemunhas com estatuto de vítimas (e/ou lesadas) e 20 arguidos(as). Os resultados adquiridos conferem a validade e consistência do instrumento utilizado e identificam a existência de motivações ajurídicas na tomada de decisão judicial.pt
dc.description.abstractThe present study intends to analyze the non-legal motivations of sentencing in Portuguese criminal justice, having as object of study the role of the witness in court and how they can influence decision-making, erecting as a reference to the psychology in justice: the perspective of Psychology when it emergesin the legal-judicial space, whether in research and intervention. The main objective of the investigation is the analysis of factors that influence judicial decision-making and whether these motivations originate in verbal communication or non-verbal communication of the deponents. The investigation was based on the Grid for Analysis of Motivations in Sentencing of Non-judicial Sentencial (GAMAS) (Poiares, 2005). The observation job was carried out at the Judicial Court of the District of Lisbon – Central Criminal Court of Lisbon with the application of the grid. The sample consists of 13 trials, with a total of 92 judicial actors, of which 56 are presented as witnesses, 16 victims, and 20 defendants. The results obtained check the validity and consistency of the instrument used and identify the existence of legal reasons in the decision-making process.en
