Resumo
A organização democrática do Estado compreende a existência de autarquias locais. O poder local submete-se a variada legislação emanada da Assembleia da República. Nos termos constitucionais as autarquias locais têm como órgãos representativos uma assembleia dotada de poderes deliberativos e um órgão executivo perante ela responsável. A lei prevê também apenas dois órgãos representativos. Contudo, na prática, nas autarquias locais o poder foi progressivamente concentrado num órgão não reconhecido constitucionalmente como o de presidente da câmara.
O atual estudo, decorrente de dissertação de mestrado, tenta demonstrar algumas especificidades do sistema de governo das autarquias locais plasmados na Constituição da República Portuguesa e na lei.
The democratic organization of the State comprises the existence of local municipalities. The «local power» complies to several legislations emanated from the Assembly of the Republic. In constitutional terms, the local municipalities have as representative bodies an assembly endowed with deliberative powers and an executive body responsible to it. The law predicts only two representative bodies as well. However, on practical terms, the power of local municipalities has progressively been concentrated in a constitutionally unrecognized body, such as that of Mayor. The present study, ongoing of a master’s degree thesis, tries to demonstrate some of the singularities of the governing system of local municipalities as detailed both in the Constitution of the Portuguese Republic and in the law.
