Resumo
A presente dissertação de mestrado tem como objetivo analisar os direitos das
crianças, designadamente a questão prática atual, referente à perceção de como estes direito se
processam, tendo como base o atual Sistema de Proteção e Promoção dos Direitos das
Crianças e Jovens em Perigo.
De forma mais detalhada, pretende-se analisar a aplicação das medidas em regime de
instituição e o seu devido acompanhamento e respetivo processamento. Fazendo referência ao
regime de apadrinhamento civil e à adoção, como também, dar primazia aos deveres dos pais
para com os seus filhos, todavia, não descorando dos direitos fundamentais das mesmas na
inserção da nossa sociedade e nos problemas inerentes.
Tendo, sempre como princípio fundamental o superior interesse das crianças.
This dissertation aims at analyzing the rights of children, namely the current practical question, regarding the perception of how these rights are processed, based on the current System for the Protection and Promotion of the Rights of Children and Young People in Danger. In a more detailed way, it is intended to analyze the application of the measures under an institutional regime and its due monitoring and processing. Referring to the regime of civil sponsorship and adoption, as well as giving primacy to the duties of parents towards their children, however, not disregarding their fundamental rights in the insertion of our society and the inherent problems. Always having as a fundamental principle the superior interest of children.
