Gestão ambiental : análise do processo de licenciamento ambiental da Fundação do Meio Ambiente do Estado de Santa Catarina - Brasil

Resumo
O presente trabalho teve como objetivo analisar o processo burocrático de liberação de
licenças ambientais por parte da Fundação do Meio Ambiente de Santa Catarina – FATMA
que é a responsável por esta obrigação estatal, a partir das percepções dos seus colaboradores
internos. O processo do licenciamento ambiental se constitui numa complexa análise que
pretende permitir o desenvolvimento de atividades consideradas potencialmente poluidoras,
dentro do princípio universalmente conhecido como sustentabilidade. Obter uma licença
ambiental é um procedimento obrigatório para as empresas cujas operações possam causar
danos ao meio ambiente, por isso torna-se relevante o conhecimento das etapas do
licenciamento ambiental, suas instituições responsáveis, bem como as sanções para as
empresas que iniciam suas operações antes de obter a devida autorização administrativa. No
presente trabalho, como instrumento principal de coleta de informações, restou produzida uma
pesquisa com os servidores do órgão em estudo - FATMA -, que trabalham no setor
responsável pela liberação das licenças ambientais, tendo os mesmos respondido um
questionário com perguntas sobre os fatores que podem afetar o processo de liberação de
licenças ambientais para as empresas, sendo essas as clientes do Poder Público. A pesquisa
quanto a metodologia utilizada é classificada como um estudo de caso, sendo que quanto a
sua abordagem classifica-se como mista, sendo qualitativa e quantitativa. Já quanto aos seus
objetivos foi realizada de forma exploratória, descritiva e explicativa, sendo que seu
delineamento complementar foi composto pela pesquisa bibliográfica e documental. Assim,
através dessa pesquisa foi possível identificar aspectos positivos como a ciência da
responsabilidade dos colaboradores da Instituição em relação à liberação ou não de licença
para as empresas solicitantes, valendo-se de critérios legalmente aceitos e específicos para o
aval estatal, através do estudo detalhado de viabilidade de cada área solicitada. E dentre os
fatores que merecem maior atenção por parte da Instituição Pública, podem se inserir aspectos
como o excesso de burocracia que retarda as liberações, a insegurança jurídica, dentre outros
apresentados no trabalho, atrapalhando de forma clara e objetiva a sociedade, as empresas
solicitantes, e o próprio Estado.
The present work aimed to analyze the bureaucratic process of releasing environmental licenses by the foundation of the Environment of Santa Catarina – FATMA, which is responsible for this state obligation, based on the perceptions of its collaborators Internal. The process of environmental licensing constitutes a complex analysis that intends to enable the development of activities considered potentially polluting, within the principle universally known as sustainability. Obtaining an environmental license is a mandatory procedure for companies whose operations can cause damage to the environment, so it becomes relevant to know the stages of environmental licensing, their responsible institutions, as well as the Sanctions for undertakings initiating their operations before obtaining proper administrative authorisation. In the present study, as the main instrument of information collection, a research was produced with the servers of the studied organ – FATMA -, which work in the sector responsible for the release of environmental licenses, having responded to a Questionnaire with questions about the factors that may affect the process of releasing environmental licenses for companies, these being the clients of the public power. The research on the methodology used is classified as a case study, and its approach classifies as mixed, being qualitative and quantitative. As for its objectives, it was performed in an exploratory, descriptive and explanatory manner, and its complementary design was composed by bibliographic and documentary research. Thus, through this research it was possible to identify positive aspects such as the science of the responsibility of the institution's employees in relation to the release or not of licence for the requesting companies, using legally accepted criteria and Specific to the state endorsement, through the detailed feasibility study of each requested area. And among the factors that deserve greater attention from the public institution, aspects such as excessive bureaucracy that delays the liberations, legal insecurity, among others presented at work, can be inserted in a clear and objective way, society, the requesting companies, and the State itself.
