dc.description.abstractA presente dissertação de mestrado dedica-se ao estudo do direito de preferência do arrendatário urbano e das principais questões que este regime tem levantado ao longo das últimas décadas. Para melhor entendimento do tema em análise, faremos uma breve resenha histórica dos direitos legais de preferência no ordenamento jurídico português. De seguida, analisaremos a evolução legislativa do direito legal de preferência do arrendatário em especial, procurando entender a razão de ser do regime que encontramos nos dias de hoje. Balizados pelo seu contexto histórico, procuramos entender o regime jurídico previsto no artigo 1091.º do Código Civil – que consagra o direito de preferência do arrendatário urbano –, designadamente, quais os elementos constitutivos desse direito, atendendo às mais recentes alterações introduzidas pela Lei n.º 64/2018, de 29 de outubro. A análise deste regime não ficaria completa sem uma análise detalhada da comunicação para preferência que, sendo transversal a todos os direitos de preferência, goza de um regime especial no que à preferência do arrendatário diz respeito. Numa fase final, faremos uma análise dos mecanismos de tutela deste direito de preferência, em especial, da ação de preferência prevista no artigo 1410.º do Código Civil. Por fim, analisaremos alguns aspetos do direito de preferência noutros ordenamentos jurídicos, procurando entender as soluções adotadas para alguns dos problemas sentidos no ordenamento jurídico português. dc.description.abstractThis master's thesis is dedicated to the study of the urban tenant's right of first refusal and the main issues that this regime has raised over the last few decades. For a better understanding of the subject under analysis, we will make a brief historical review of the legal rights of preference in the Portuguese legal system. Next, we will analyze the legislative evolution of the legal right of preference of the lessee in particular, trying to understand the reason for the regime that we find today. Based on its historical context, we seek to understand the legal regime provided for in article 1091.º of the Civil Code - which enshrines the urban tenant's right of preference -, namely, what are the constitutive elements of this right, taking into account the most recent changes introduced by Law n.º 64/2018, of October 29th. The analysis of this regime would not be complete without a detailed analysis of the notice for preference which, being transversal to all preemptive rights, enjoys a special regime with regard to the lessee's preference. In a final phase, we will analyze the mechanisms of protection of this preemptive right, in particular, the preemptive action provided for in article 1410.º of the Civil Code. Finally, we will analyze some aspects of the right of preference in other legal systems, trying to understand the solutions adopted for some of the problems felt in the Portuguese legal system.
