O regime democrático e a consagração constitucional dos direitos de proteção social impõem ao Estado português o dever de garante do direito à proteção da saúde, importante direito social assente em valores fundamentais como a dignidade humana, a ética, a equidade e a solidariedade. O direito à saúde pugna por um modelo de administração pública eficiente, que encontra na regulação um fator de equilíbrio e de justiça social. O imperativo ético de promoção da saúde, que confere efetividade ao princípio da equidade no acesso à saúde, sofre condicionantes financeiras. A definição do pacote básico de serviços de saúde disponibilizados obedece a critérios de razoabilidade, pois o nível de produção de cuidados é limitado pelos recursos disponíveis. No presente estudo procede-se à análise da regulação independente do setor da saúde, considerando o papel da concorrência como catalisador da qualidade global do sistema de saúde nacional.
Para aferir do estado da arte, no estudo da concorrência e regulação independente do setor da saúde, procede-se a um enquadramento teórico, com recurso a obras de referência, decisões jurisprudenciais, relatórios e pareceres de vários organismos e entidades.
Perspetivado o setor da saúde numa linha de promoção da concorrência e de defesa da boa regulação do mercado da saúde, importa avaliar o contributo da concorrência no fomento da qualidade global do sistema de saúde, considerando a importância da regulação como fator de promoção da liberdade de escolha no mercado da saúde.
Conclui-se que uma particular intervenção regulatória, independente, contribui para corrigir as disfunções do mercado da saúde, disciplinando a atuação dos operadores no sentido do fortalecimento da liberdade de escolha e do direito de acesso equitativo ao sistema público de saúde.

The democratic regime and the constitutional consecration of social protection rights impose on the Portuguese State the duty to guarantee the right to healthcare protection, an important social right based on fundamental values such as human dignity, ethics, equity and solidarity. The right to healthcare strives for an efficient public administration model, which finds in regulation a factor of balance and social justice. The ethical imperative of health promotion, which gives effectiveness to the principle of equity in access to health, suffers financial constraints. The definition of the basic package of healthcare services provided meets reasonableness criteria as the level of care output is limited by the resources available. The present study analyzes the independent regulation of the healthcare sector, considering the role of competition as a catalyst for the overall quality of the national healthcare system. To assess the state of the art, in the study of competition and independent regulation of the healthcare sector, we proceed to a theoretical framework, using reference works, jurisprudential decisions, reports and opinions of various bodies and institutions. With the healthcare sector in view of promoting competition and defending good regulation of the healthcare market, it is important to evaluate the contribution of competition in promoting the overall quality of the healthcare system, considering the importance of regulation as a factor promoting freedom of choice in the healthcare market. It is concluded that a particular independent regulatory intervention contributes to correct the healthcare market dysfunctions, disciplining the operators' actions towards the strengthening of freedom of choice and the right of equitable access to the public health system.
