Resumo
Os direitos fundamentais sãos as premissas orientadoras de um Estado de Direito Democrático. Para se viver em paz social é preciso cumprir com os deveres fundamentais e respeitar os direitos fundamentais inerentes aos outros.
Portanto, o comportamento das pessoas deve estar em conformidade com os preceitos fundamentais do ordenamento jurídico, de forma a evitar conflitos de interesses, que surgem quando as normas jurídicas são desrespeitadas.
Os direitos fundamentais, enquanto direitos subjetivos das pessoas podem ser definidos e garantidos constitucionalmente, o que por sua vez, vem limitar o exercício do poder estatal.
Para se verificar a existência dos direitos fundamentais, sobretudo, dos direitos sociais, primeiramente é preciso verificar a existência da própria pessoa humana, a quem as normas serão aplicadas.
Os direitos fundamentais constituem uma unidade, em cada ordenamento jurídico, que são categorizados em categorias diferentes, segundo a sua relevância e interesses tutelados, como os direitos sociais.
Os direitos e garantias fundamentais vêm expressar as condições mínimas de convivência em sociedade democráticas, os valores e interesses valorados e as garantias a tutelar.
Fundamental rights are the guiding premises of a democratic rule of law. To live in social peace, it is necessary to fulfill fundamental duties and respect the fundamental rights inherent in others. In order to verify the existence of fundamental rights, especially social rights, it is first necessary to verify the existence of the human person himself, to whom the rules will be applied. Fundamental rights constitute a unit, in each legal system, which are categorized in different categories, according to their relevance and protected interests, such as social rights. The fundamental rights and guarantees come to express the minimum conditions of coexistence in democratic societies, the values and interests valued and the guarantees to be protected.
