Um estudo sobre o direito fundamental do acesso à justiça à luz da dignidade da pessoa humana: uma perspectiva entre Brasil e Portugal

Resumo
A pesquisa proposta nesta dissertação de Mestrado em Ciências Jurídico-Publicísticas traz
percepções sobre o direito do acesso à justiça à luz da dignidade da pessoa humana
consoante previsão no ordenamento jurídico brasileiro e português. O estudo investiga
questões pertinentes envolvendo a noção de justiça e sua importância na área da filosofia e
do direito, notadamente sob o enfoque que foi dado por pensadores como Aristóteles, Hans
Kelsen e John Rawls. Como objetivo geral, a dissertação investigou a evolução do direito de
acesso à justiça à luz do direito brasileiro e português com vistas ao desdobramento do
ordenamento jurídico-constitucional na busca pela efetivação da justiça como direito
fundamental, em respeito ao princípio da dignidade da pessoa humana. Para debater os
pontos mais importantes dessa temática, a pesquisa apresentou a evolução histórica dos
direitos fundamentais no contexto da Constituição da República Portuguesa de 1976
(CRP/76) e da Constituição da República Federativa do Brasil de 1988 (CRFB/88) com
vistas ao direito de acesso à justiça previsto nas respectivas Constituições. Nesse contexto, é
possível identificar como problemática alguns questionamentos, os quais abrangem o apego
à aplicação formal do Direito segundo princípios rígidos da lógica e da hermenêutica como
obstáculo ao acesso ao direito e à justiça, bem como se os instrumentos disponibilizados
pela ordem jurídica são suficientes para garantir a efetividade do direito de acesso à justiça e
se existem fatores de facilitação do acesso à justiça. Como resultado, a pesquisa demonstrou
que é preciso ajustar-se a uma nova cultura que vise não apenas à redução da excessiva
judicialização, embora seja de extrema valia tais expectativas de redução do acervo de
processos que hoje tramitam no Judiciário, mas sobretudo que vise criar condições para que
os conflitos de interesses possam vir a ser pacificados por métodos plurais, de forma
adequada às suas particularidades, tendo em vista a efetivação do direito fundamental de
acesso integral à justiça por métodos apropriados de gestão de conflitos e com uma
prestação jurisdicional justa, adequada e em prazo razoável.

The research proposed in this master's thesis in Legal Sciences brings perceptions about the right of access to justice in the light of the dignity of the human person, as predicted in the Brazilian and Portuguese legal systems. The study investigates pertinent questions involving the notion of justice and its importance in the area of philosophy and law, notably under the focus that was given by thinkers like Aristotle, Hans Kelsen and John Rawls. As a general objective, the dissertation investigated the evolution of the right of access to justice in the light of Brazilian and Portuguese law with a view to unfolding the legal-constitutional order in the search for the realization of justice as a fundamental right in respect to the principle of human dignity. To debate the most important points of this theme, the research presents the historical evolution of fundamental rights in the context of the Constitution of the Portuguese Republic of 1976 (CRP / 76) and the Federal Constitution of the Republic of Brazil of 1988 (CRFB / 88) with a view to right of access to justice provided for in the respective Constitutions. In this context, it is possible to identify as problematic some questions which include the attachment to the formal application of law according to rigid principles of logic and hermeneutics as an obstacle to access to law and justice, as well as whether the instruments provided by the legal system are sufficient to guarantee the effectiveness of the right of access to justice and whether there are factors that facilitate access to justice. As a result, the investigation shows that it is necessary to adapt to a new culture that sees only the reduction of excessive judicialization, such expectations of reducing the collection of lawsuits that are being processed in the judicial process are extremely valuable, but mainly to create conditions for conflicts of interests can be pacified by multiple methods, in a manner appropriate to their particularities, in view of the fundamental guideline of full access to justice through appropriate methods of conflict management and with a fair, adequate and within a reasonable time.
