dc.description.abstractA violência conjugal tem vindo a ter um crescimento significativo ao nível da sua visibilidade e denúncia, uma vez que cada vez mais, embora num processo lento, seja uma temática ao nível da violência, a combater e minimizar, com uma grande aposta ao nível da sua prevenção. Desta forma, a decisão judicial, no âmbito desta problemática, tem vindo a estar cada vez mais no foco da curiosidade e olhar público, uma vez que, até há bem pouco tempo poucos eram os casos de violência conjugal mediatizados e que chegavam a um tribunal. O presente estudo procurou, a partir de uma análise qualitativa a oitenta acórdãos das Comarcas de Lisboa, Porto, Guimarães e Évora, compreender os fatores considerados como agravantes e atenuantes na decisão Judicial e a sua fundamentação, bem como são descritas a vítima e o agressor. Pretendeu-se ainda perceber se existem diferenças nos acórdãos das diferentes Comarcas. Tratando-se de um estudo qualitativo, utilizou-se como estratégias analíticas a análise temática, com recurso ao software de análise qualitativa de dados NVIVO 12. Concluiu-se que existem diferenças de relato nos diferentes itens abordados nas diferentes Comarcas, verificando-se em alguns deles(itens) diferenças das Comarcas do Norte em relação às Comarcas mais a Sul.pt
dc.description.abstractMarital violence has been growing significantly in terms of its visibility and denunciation, since increasingly, albeit in a slow process, it is a theme of violence, combating and minimizing violence, with a strong commitment to violence. prevention. In this way, the judicial decision, in the context of this problem, has been increasingly in the focus of curiosity and public gaze, since until very recently few cases of marital violence were mediated and that they reached a court. The present study sought, from a qualitative analysis of eighty judgments of the Lisbon, Porto, Guimarães and Évora Counties, to understand the factors considered as aggravating and mitigating factors in the Judicial decision and its rationale, as well as describing the victim and the aggressor. The intention was also to see if there were differences in the judgments of the different Counties. As a qualitative study, thematic analysis was used as analytical strategies using the NVIVO qualitative data analysis software 12. It was concluded that there are differences of reporting in the different items approached in the different Comarcas, being verified in some of them (items) differences of the Comarcas of the North in relation to the Comarcas more to the South.en
