dc.description.abstractSabe-se que as decisões judiciais são atualmente alvo de estudo, afirmando-se que as motivações ajurídicas influenciam diretamente as decisões do juiz. Assim sendo, a presente investigação tem como principal foco analisar a influência das motivações ajurídicas do sentenciar nas decisões judiciais com base na Grelha para Análise da Motivações Ajurídicas do Sentenciar (GAMAS). Este trabalho pretende apurar se existem fatores que influenciam a tomada de decisão do juiz, de onde advêm e qual a importância que os mesmos tem no sentenciar, não esquecendo a comunicação verbal e não-verbal. Para tal realizou-se um trabalho de observação nas 7ª e 8ª Varas Criminais do Campus de Justiça de Lisboa no qual foi aplicado a grelha. A amostra é constituída por 34 arguidos que prestaram depoimento durante o seu julgamento. Os resultados demonstram uma influencia estatisticamente significativa dos tipos de comportamento (verbal e não verbal) nas decisões do juiz (p<0.05). Foram encontradas como principais dificuldades, o facto de não ter sido possível ter acesso a um número maior de julgamentos, sugerindo-se a replicação do estudo num número considerável de arguidos.pt
dc.description.abstractIt is known that judicial decisions are currently the focus of study, it is stated that the sentencing of non-judicial motivations influence directly the judge’s decisions. Thus, this research main focus is to analyse the influence of the sentencing of non-judicial motivations in the judicial decisions based on the Grid for Analysis of Motivations in Sentencing of Non-judicial Sentencing (GAMAS). This work is expected to determine if there are factors that influence the judge’s decisions, where they are from and their importance in the sentencing, not forgetting the verbal and non-verbal communication. For this purpose, there was an observational job done in the 7th and 8th criminal courts at the justice campus in Lisbon in which the grid was applied. The sample consisted of 34 defendants who testified during their trials. The results show that there is a significant statistic influence on the types of behaviour (verbal and non-verbal) in the judge’s decisions (p<0,05). It was found that the primary difficulty was that it was not possible to have access to a greater number of trials and it is suggested that this study be repeated with a considerably bigger number of defendants.en
