Resumo
A presente investigação, intitulada “Overbooking - A Inexecução Contratual do
Transportador Aéreo e a Proteção Jurídica dos Passageiros Aéreos na União Europeia
Vítimas Desta Prática”, tem como objeto analisar um dos principais problemas suscitados
no âmbito do contrato de transporte aéreo, a recusa de embarque por Overbooking.
O Overbooking, essencialmente a sobre venda de passagens, – é uma prática comum das
companhias aéreas que consiste na venda de bilhetes além da quantidade de lugares
disponíveis nas aeronaves, embora as empresas justifiquem tal prática como sendo uma
estratégia de tentar minimizar as perdas de receitas decorrentes dos passageiros que
acabam por não comparecer no momento do embarque à hora prevista – os chamados
casos de no-show.
Nada justifica que um passageiro que já tenha comprado sua passagem e estando
perfeitamente em dia com suas obrigações, como acordado no contrato de transporte, seja
impedido de viajar porque a companhia aérea vendeu mais bilhetes do que a quantidade
de lugares disponível na aeronave.
Trata-se de um assunto que está na ordem do dia da aeronáutica, fundamentalmente após
a ocorrência de diversos casos que chocaram o mundo.
Tendo em consideração a quantidade de pessoas embarcando todos os anos e o alto índice
de reclamações e processos judiciais por parte dos passageiros que, sentindo violados os
seus direitos, continuam a apresentar em face desta ocorrência, é de extrema importância
abordar este tema já que tem provocado grandes transtornos e inconvenientes aos
passageiros aéreos.
Apesar das divergências doutrinárias, entendemos que a recusa de embarque por
Overbooking, embora tenha acolhimento na lei, corresponde a um incumprimento
contratual, e, enquanto tal, ilícito.
The present investigation, entitled “Overbooking – Which consist of The Contractual Failure of the Air Carrier and the Legal Protection of Air Passengers in the European Union Victims of overbooking”, aims to analyze the one of the main problems raised under the air transport contract, a denied boarding for Overbooking”. Overbooking, mainly about ticket sales, - is a common airline practice that consists of selling tickets in addition to the number of seats available on aircraft. However, companies justify those practices as a strategy of trying to minimize the loss of revenue resulting from passengers who end up not arriving at boarding time – knowing as no show cases. There is nothing that justifies a passenger who has fulfilled all his obligations as agreed in the transport contract, to be prevented from traveling because the airline sold more tickets than his capacity of seats available on the aircraft. This issue is on the agenda of aeronautics, fundamentally after the occurrence of several cases that shocked the world. Taking into account the number of passengers that boarding every year, the high rate of complaints and lawsuits by passengers, who feeling violated their rights, continue to present in the face of that matters, it is extremely important to address this issue as it has caused uncounted inconvenience to the air passengers. Despite of several doctrinal divergences, understand that the refusal of boarding by Overbooking, although have law protections, corresponds to a contract and, as such, unlawful breach.
