Resumo
A presença das Novas Tecnologias da Informação e Comunicação dinamiza a troca contínua de informação entre os interlocutores da relação laboral, que interagem através do respetivo fluxo comunicacional, ligando-os a qualquer instante e em qualquer local, através dos diversos equipamentos eletrónicos à sua disposição. Esta realidade contribui para a diluição do respeito dos momentos de repouso e descanso do trabalhador. Partindo destas constatações, concretizamos um estudo da legislação, nacional e internacional, confrontando-a com bibliografia dedicada a este tema, visando uma análise ao dever de abstenção de contacto consagrado no Código do Trabalho, pela qual salientamos os elementos relevantes deste instituto, procurando identificar alguns problemas e sugerir possíveis soluções, quer por via regulamentar, quer por via legislativa e identificando a desconexão enquanto conceito que o empregador e o trabalhador carecem de interiorizar, para melhor se compatibilizar o labor com a vida extralaboral. The presence of New Information and Communication Technologies streamlines the continuous exchange of information between the interlocutors of the employment relationship, who interact through the communication flow, connecting them at any time and in any location, through various electronic equipment at their disposal. This reality contributes to the dilution of respect for workers' moments of tranquility and rest. Based on these findings, we carried out a study of national and international legislation, comparing it with the bibliography dedicated to this topic, going through an analysis of the duty to abstain from contact enshrined in the Labor Code, through which we highlight the relevant elements of this institute, seeking to identify some possible problems and solutions, either through regulation or through legislation, and identifying disconnection as a concept that the employer and worker need to understand, to better harmonize professional and extra-work life.
