A aplicação do princípio da proibição do retrocesso social no contexto neoliberal de prestação de serviços públicos

Num corredio cenário em que a prestação de serviços públicos essenciais se apoia em situações
aparentemente antagônicas de manutenção das conquistas sociais, é instigante tecer um
(re)olhar para o Princípio da Proibição do Retrocesso Social. Assim sendo, o presente trabalho
de pesquisa tenciona explorar a funcionalidade do referido Princípio na subsistência dos direitos
sociais em meio à inserção e ascensão das políticas liberalizadoras e privatizadoras dos serviços
públicos. Trata do direito constitucional, embora, transite pelo direito administrativo e, às vezes,
pela sociologia. Antes de ingressar no mérito do tema, à luz da doutrina contemporânea e
clássica, houve necessidade de abordar alguns assuntos conexos, como, direitos sociais, Estado
Social, Estado Neoliberal (e suas variantes ideológicas) e serviços públicos, bem como, os
respectivos carácteres geral, histórico-evolutivo e conceitual desses temas. Também, apresenta
a correlação entre o Princípio da Proibição do Retrocesso Social e os Poderes Constituídos,
como ainda, dilucida os princípios da ordem democrática com os quais mantêm maior relação
de proximidade (princípio da dignidade humana, princípio da proporcionalidade, princípio da
segurança jurídica e mínimo existencial). Por fim, procura destacar a importância da
preservação e continuidade das conquistas sociais, materializados pelos serviços públicos
essenciais, por meio da ressignificação do Princípio do da Proibição do Retrocesso Social.
In a fast-paced scenario in which the provision of essential public services is supported by seemingly antagonistic situations of maintaining social achievements, it is instigating to weave a (re) look at the Principle of Prohibition of Social Retrocession. Therefore, the present research work intends to explore the functionality of the referred Principle in the subsistence of social rights in the midst of the insertion and rise of the liberalizing and privatizing policies of public services. It approaches constitutional law, although it passes through administrative law and, sometimes, through sociology. Before going into the merit of the theme, in the light of contemporary and classic doctrine, there was a need to address some related issues, such as social rights, Social State, Neoliberal State (and its ideological variants) and public services, as well as the respective general, historical-evolutionary and conceptual character of these themes. It also presents the correlation between the Principle of Prohibition of Social Retrocession and the Constituted Powers, as well as enlightening the principles of the democratic order with which they maintain a closer relationship (principle of human dignity, principle of proportionality, principle of legal security and existential minimum). Finally, it seeks to highlight the importance of preserving and continuing social achievements, materialized by essential public services, through the reframing of the Principle of Prohibition of Social Retrocession.
