Resumo
A presente dissertação tem como objetivo o estudo das responsabilidades dos terceiros
garantes, nomeadamente as responsabilidades do fiador em consequência do incumprimento
da prestação da obrigação pelo devedor principal.
Através do estudo individualizado da figura da fiança no regime do Código Civil e a par
da confrontação com as figuras do aval e da garantia autónoma, comprometemo-nos a
analisar os requisitos de forma deste instituto necessários para garantir a satisfação do direito
de crédito do credor, bem como os meios de defesa ao dispor do fiador como mecanismo de
desvinculação.
The present dissertation aims to study the responsibilities of third parties guarantors, namely the guarantor's responsibilities as a result of the non-compliance of the obligation by the main debtor. Through the individual study of the figure of the guarantee in the Civil Code regime and alongside the confrontation with the figures of the endorsement and the autonomous guarantee, we undertake to analyze the formal requirements of this institute necessary to guarantee the satisfaction of the creditor's right, as well as the legal means of defense available to the guarantor as a mechanism for untying.
