Resumo
Esta investigação aborda o tema da pena de prisão, mais especificamente, o limite
máximo que existe no sistema sancionatório português aplicado a esta privação de
liberdade. De uma forma geral, será abordada a evolução histórica da pena de prisão,
bem como, em específico, o caso português. A fim de fornecer uma estrutura e
compreender as ideias por detrás das penas privativas de liberdade, examinaremos os
propósitos das penas, no seu sentido preventivo versus retributivo. Terminaremos a
nossa apresentação com a razão deste limite no nosso sistema, olhando
especificamente para a revisão de 1995, que foi a mais relevante nesta área. Também
analisaremos, criticamente, se esse limite faz sentido ou precisa ser alterado.

This research deals with the subject of prison sentences, more specifically, the maximum limit that exists in the Portuguese sanctioning system applied to this deprivation of liberty. In general, the historical evolution of the prison sentence will be addressed, as well as specifically in the Portuguese case. In order to provide a framework and understand the ideas behind custodial sentences, we will look at the purposes of sentences, in their preventive vs. retributive sense. We will end our presentation with the reason for this limit in our system, looking specifically at the 1995 revision, which was the most relevant in this area.
